How can I file for expunction?

An expunction is the same thing as an expungement. Expunction is just the word that North Carolina uses to refer to the process of sealing or removing criminal records. If you have a criminal record, sealing them can allow you to have better job prospects, get housing easier and avoid common issues you may have due to having a criminal record. The first step in the process is making sure you know where to file.

According to the North Carolina Judicial Branch, you will need to file your case with the county clerk of court. This is the clerk in the county where you went to court and received your conviction for the charge or charges you want the court to seal. The clerk can explain the procedure for that jurisdiction so that you know what you need and how to proceed once you file the initial paperwork.

You can find what you need to file your case online. The forms you need, along with instruction sheets on how to fill them out are on the website of the North Carolina Judicial Branch. However, you may need additional forms that will not be in those files within the online system, but the instruction sheets will cover them so that you know what you need.

Do keep in mind that the process may be different for some convictions or situations. You may have to pay a fee in some cases. You may need additional documents. You should review the statute pertaining to your case and seek legal advice if you are unsure about the expunction process for your personal situation.
