Judge found our client not guilty after all evidence came to light. Client avoided up to 150 days in jail.
The Situation
A bar fight turned into more serious charges because the alleged victim went to the doctor days later alleging our client broke his ribs. The client was originally charged with Class 2 Simple Assault charge facing a possible penalty of up to 60 days in jail. After the alleged victim in the case submitted a sensationalized statement to the State of North Carolina, our client’s charges were amplified to Class A1 Assault Inflicting Serious Injury charges facing a possible penalty of 150 days in jail.
Our Approach
We got the Forsyth County District Attorney to hand over all AXON body camera footage of the alleged victim. In reviewing the footage, it became obvious the injuries alleged were not consistent with what was seen on camera. Moreover, each time the alleged victim gave a statement it got increasingly sensationalized. So we took it to trial.
At trial, criminal defense lawyer Dylan Greenwood artfully broke down each of the alleged victim’s statements, pointing out inconsistencies and illogical claims. Evidence had to be presented, however, and the Defense’s evidence consisted of testimony from an independent witness and the Client. We don’t recommend that in very many cases, but it made perfect sense in this scenario.
The Result
The court, after hearing all evidence, found our client Not Guilty by reason of justifiable self-defense.
