What Do DWI Charges Mean In North Carolina?

In North Carolina, drivers cannot operate a vehicle while noticeably impaired or with a blood alcohol concentration (BAC) of 0.08 or higher. North Carolina categorizes DWIs into one of five levels, with Level V being the least serious and Level I being the most serious. If a court finds you guilty of a DWI, the judge will sentence you, accounting for certain aggravating or grossly aggravating factors, as well as mitigating factors, based on the level of the crime:

Level V – This Level has a fine of up to $200 and a minimum jail sentence of 24 hours and a maximum of 60 days. Although a judge can suspend the sentence, the driver must “spend 24 hours in jail, perform 24 hours of community service, or not operate a vehicle for 30 days.”
Level IV – For a Level IV violation, the fine increases to up to $500 and carries a minimum jail sentence of 40 hours with a maximum of 120 days. Similarly, a judge can suspend the sentence upon the driver’s completion of 48 hours in jail, 48 hours of community service, or not operating a vehicle for 60 days.
Level III – A driver with a Level III violation faces a fine of up to $1,000 and a minimum 72-hour stay in jail, up to a maximum of six months. If the driver spends 72 hours in jail, performs 72 hours of community service, or does not drive for 90 days, the judge can suspend the sentence.
Level II – The fine for a Level II violation increases to up to $2,000 and a minimum jail sentence of seven days with a maximum of one year. Unlike the prior level crimes, a judge cannot suspend the minimum sentence.
Level I – The highest level, a Level I violation carries a fine of up to $4,000 with a minimum jail sentence of thirty days and a maximum of two years. Like a Level II violation, a judge cannot suspend the minimum sentence.

North Carolina requires that “impaired drivers must complete a substance abuse assessment and comply with any recommended treatment as a condition for having their driver’s license restored at the end of the revocation period.”
